关于船舶战争险除外区域变更的通函

伦敦保险市场联合战争险委员会根据全球安全形势的变化,特别是近期发生于阿联酋富查伊拉（FUJAIRAH）水域的针对油轮的攻击事件，于近日召开紧急会议并于2019年5月17日针对原除外区域清单（2018年6月14日除外区域清单）进行修改后发布了新的除外区域清单，根据新修订的海盗区，阿曼、波斯湾部分海域、阿联酋沿海部分地区等被新加入到海盗区，沙特附近沿海海域范围作了修改。具体请详参附件《联合战争险委员会船舶战争、海盗、恐怖主义风险和相关风险除外区域清单-发布日期2019年5月17日》（JWC Hull War, Piracy, Terrorism and Related Perils Listed Areas, 17 May 2019）

 

近期沙特产油区袭击事件有加剧的趋势，且美国、沙特与伊朗在波斯湾地区存在爆发冲突的潜在可能，加之地区局势紧张，后续海盗区范围存在进一步随时进行修改的可能。

 

在新的除外区域清单生效后（即2019年5月17日之后），如船舶正在或欲进入清单中列出的除外区域，应确保事先联系战争险保险人，确认保险人针对船舶经过除外区域的附加费率及承保条件，以配置针对战区的特战险。

 

请注意，战争险保险人所报的上述附加费率和保险条件通常仅在48小时内有效，即，如果船舶未能在48小时有效期内驶入除外区域，该附加费率和承保条件将自动失效。被保险人需在船舶实际到达除外区域48小时前重新通知保险人，并确认有效的附加费率和承保条件。

伦敦保险市场联合战争险委员会根据全球安全形势的变化特别是近期发生于阿联酋富查伊拉（FUJAIRAH）水域的4起针对油轮的攻击事件，于近日召开了紧急会议并于2019年5月17日针对原除外区域清单（2018年6月14日除外区域清单）进行修改后发布了新的除外区域清单，即附件《联合战争险委员会船舶战争、海盗、恐怖主义风险和相关风险除外区域清单-发布日期2019年5月17日》（JWC Hull War, Piracy, Terrorism and Related Perils Listed Areas 17 May 2019）（以下简称“2019年5月17日除外区域清单”）。

 

鉴于以上，中国船东互保协会根据本协会现行保险条款第五条（十一）款3项1)目的规定：“本协会或会员有权在任何时候发出通知解除在本第（十一）款下的保险” （或PICC86 船舶战争、罢工险条款第3条1款或Institute War and Strikes Clauses Hulls-Time 1/10/83 第5条1款或其它承保条件中并入的类似条款）以及伦敦保险市场联合战争险委员会2005年6月20日发布的与除外区域清单配套使用的《有关船舶战争、罢工、恐怖主义风险和相关风险航行区域限制的背书》（Navigation Limitations for Hull War, Strikes, Terrorism and Related Perils Endorsement (JW2005/001A)）和修正后的伦敦保险市场联合战争险委员会2005年6月20日发布的与除外区域清单配套使用的《撤销船舶战争、罢工、恐怖主义风险和相关风险的操作条款》（Hull War, Strikes, Terrorism and Related Perils Notice of Cancellation Administration Clause（JW2005/001B）），在此发布撤销定期船舶战争保险的通知。原定期船舶战争保险合同将于2019年5月30日2400时（格林威治时间）被撤销。同时，该定期船舶战争保险合同将于2019年5月31日0001时（格林威治时间）自动恢复，但适用2019年5月17日除外区域清单，而2018年6月14日除外区域清单将不再适用。

 

针对上述变化，协会简要说明如下,仅供会员公司参考：

 

2019年5月17日除外区域清单与2018年6月14日除外区域清单相比，变化如下：

 

增加:

阿曼 Oman

波斯湾或阿拉伯湾及其附近水域，包括东经58°E以西的阿曼湾Persian or Arabian Gulf and adjacent waters including the Gulf of Oman west of Longitude 58°E

阿拉伯联合酋长国 United Arab Emirates

 

修订:

沙特阿拉伯(海湾沿岸) Saudi Arabia (Gulf coast)

沙特阿拉伯(红海沿岸)，过境除外Saudi Arabia (Red Sea coast) excluding transits

 

各会员公司的船舶在新的除外区域清单生效后，如正在或欲进入清单中列出的除外区域，应确保事先（最好提前48小时）通知协会，并同意附加费率及变更的保险条件。即便如此，协会在此提醒各会员公司，协会及其他战争险保险人所报的此类附加费率和保险条件通常仅为48小时有效，即，如果船舶未能在48小时有效期内驶入约定的区域，该附加费率和保险条件将自动失效。被保险人需在船舶到达有关区域之前重新通知保险人，并确认有效的附加费率和保险条件。

The Joint War Committee has recently reviewed the Listed Areas, and has agreed the following changes which are incorporated in the new list as attached.

Added:        Oman

Persian or Arabian Gulf and adjacent waters including the Gulf of Oman west of Longitude 58°E

United Arab Emirates

Amended:  Saudi Arabia (Gulf coast)

Saudi Arabia (Red Sea coast) excluding transits

 

The application of this list on individual contracts will be a matter for specific negotiation.

 

This list will be published on the LMA and IUA websites and will be accessible to all on www.lmalloyds.com and www.iua.co.uk.

Definitions:

Named Countries shall include their coastal waters up to 12 nautical miles offshore, unless specifically varied above.

Named Ports shall include all facilities/terminals within areas controlled by the relevant port authority/ies (or as may be more precisely defined by Insurers) including offshore terminals/facilities, and all waters within 12 nautical miles of such but not exceeding 12 nautical miles offshore unless specifically stated.

 

Indian Ocean / Arabian Sea / Gulf of Aden / Gulf of Oman / Southern Red Sea

The waters enclosed by the following boundaries:

a) On the north-west, by the Red Sea, south of Latitude 15° N

b) on the west of the Gulf of Oman by Longitude 58° E

c) on the east, Longitude 65° E

d) and on the south, Latitude 12° S

excepting coastal waters of adjoining territories up to 12 nautical miles offshore unless otherwise provided.
