Reference is made to the Member Alert of February 5, 2018, People’s Republic of China (PRC):
New Regulations Regarding the Importation of Solid Waste which provided a catalogue of banned
solid wastes.

This list has been updated to include:
该份清单现已更新，包括如下内容：
1. (Effective December 31, 2018): 16 types of solid waste, including scrap metal, ship scrap,
compressed pieces of scrap automobile, smelt slag and industrial waste plastic; and
（自2018年12月31日起生效执行）：16种固体废物，包括废五金类、废船、废汽车压件、冶炼渣、工业来源废塑料；以及
2. (Effective December 31, 2019): 16 types of solid waste including stainless steel waste and
scrap, titanium waste and scrap, wood waste and scrap.
（自2019年12月31日起生效执行）：16种固体废物，包括不锈钢废料、钛废料、木材碎料。
The catalogue of banned wastes in the PRC can be found as follows:
• Currently banned solid wastes;
• Additionally banned solid wastes as of December 31, 2018; and
• Additionally banned solid wastes as of December 31, 2019.

根据中国相关法规，对于将境外固体废物倾倒、堆放、处置以及未经许可进口违禁或者限制固体废物的行为，海关当局将责令船东将废物退运至其原厂地并处以罚金。如果该行为构成犯罪，则船东可能面临刑事处罚。协会建议船舶或会员应对去往中国港口的废物运输特别警惕。建议会员在订立运往中国的合同之前采取措施以确保货物中不含违禁或者限制性固体废物，同时应要求booking party提供准确信息、海关代码以及相关证书以确保运至中国航次的货物合法性。
