The Association announced about the problem regarding the ballast water inspections by the local ecological inspectors in Ukraine. (No.744No.838No.849)

The Association has been informed by Dias Marine Consulting p.c., our correspondent in Ukraine, of the development of this problem that Ukrainian law on the segregated ballast quality control on board ships has become effective again in 2017.

At our request,Viktoria Kovalchuk, the lawyer of the Legal Force Law Offices has written a brief legal review concerning the situation with ecological inspections of the vessels. As it is seen from the information below, we regret to inform you that the officials of Ecological Inspection have again gained the authority to take samples of the segregated ballast and to make laboratory analysis:

应本司请求,Legal Force律师事务所的Viktoria Kovalchuk律师对船舶生态环保检验情况出具一份简要的法律意见书。根据下述内容,我们抱歉地通知您,生态环保监察局官员再次获权对船舶分隔压载水取样并进行实验室分析:

We refer to the matter of latest changes in Ukrainian legislation regarding rights and authorities of Ukrainian Ecological Inspection upon the control of the foreign vessels during their stay at Ukrainian ports.

乌克兰法律关于乌克兰生态环保监察局对停靠其港口的外国船舶进行管控的权利与权限的最新动态:

 

1.In accordance with Ukrainian law in case existence of pollution State Port Administration should notify Ecological Authorities which from their side should arrange inspection of the vessel and calculation of caused by pollution damages. However, lately the State Port Administration of Ukrainian ports allows the officials of Ecological Inspection to fulfill the observation of the port water area near the vessels situated in port and does not prevent their movement on port territory.

依据乌克兰法律,如果存在污染,港口管理局应当通知生态环保监察局,生态环保监察局将自行安排渉污船舶检验并计算环境损失。然而,乌克兰港口管理局近期允许生态环保监察局官员对在港船舶附近水域进行观测,且不干预其在港口区域内的行动。

 

2.In accordance with Ukrainian law in case the signs of pollution can be seen (membranes, particles, discoloration of water) the Ecological Inspection has a right to come onboard and to perform sampling and instrumental and laboratory measurements of the composition and properties of stationary sources of pollution of sewage, ballast, reverse, surface and marine waters.

根据乌克兰法律,如果观察到污染迹象膜、颗粒、水变色)生态环保监察局有权船,生活污水、压载水、reverse(淡水、逆流水)、表层水以及海水污染源进行取样,并对其组成和属性进行仪器和实验室检测。

 

In the view of the above, we draw your attention that current legislation returned a right of Ecological Inspection to take samples of isolated ballast also.

鉴于上述情况,提请注意,现行法律同样返还了生态环保监察局对于隔离压载水进行取样的权利。

 

3.In case the Inspection is not allowed to come onboard and to take samples the Inspection usually after the loading operations are finished does not put a stamp of “radiological control” on the cargo documents keeping the vessel depended from their visit and speculating by the relevant their right. The actions of The Inspection can be appealed by it takes much time for relevant legal actions at court which leads to unreasonable delay in departure of the vessel.

如果检查官被拒绝登轮及取样,在装货作业结束后,生态环保监察局通常拒绝在货物单据上加盖“放射性控制”的印章,无此印章船舶便无法离港。船东可对生态环保监察局行为向法院提起诉讼,但是法院诉讼可能要花费很长时间,这将造成船期的极大延误


4.After the inspection is arranged and the samples are taken the Ecological Inspection calculates the damages (if any) and provides the shipowner with the relevant statement of claim with the demand to pay the damages.

在完成检验和取样之后生态环保监察局会对损害情况进行计算(若存在损坏情况),并向船东提供索赔清单,要求支付损害赔偿

 

We draw your attention that current Ukrainian legislation does not have an approved Procedure and Order of calculation of damages caused by pollution from maritime vessels. The previous document was cancelled in 2017 and the new one has not been established yet. In the view of the above, the damages which are currently calculated by Inspection do not have legal ground and can be appealed during further court procedures.

提请注意,关于压载水取样检测的具体程序和环境损失的计算标准,乌克兰目前并没有现行有效的法律法规。之前相关的法律法规已于2017年被废除,新的法律法规尚未设立。鉴于上述情况可知乌克兰现行的环境损失计算标准没有法律支持,可以在进一步的庭审程序中予以上诉。
