Changes to Vietnamese customs rules on the export of limestone have led to vessel detentions.
In December 2020, the General Department of Vietnam Customs introduced new requirements to strictly control the export of limestone. Accordingly, customs officials now review the export declarations of any goods declared as limestone, calcium-containing stone, and construction stone.Customs are focusing on the classification code declared by the exporter (the shipper) to ensure it accurately reflects the commodity. Limestone with a calcium carbonate content of 85% or more falls into a different code than that with a content of less than 85% – the former is subject to a higher tax rate and requires permission to export from the Ministry of Natural Resources and Environment.
Vietnamese law firm Anhisa report that some exporters were unable to present this permission and therefore their limestone shipments were detained. The affected laden vessels were not granted port clearance to sail, some of which have been detained for more than 60 days.
When fixing or loading limestone cargoes from Vietnam, be aware of this new customs requirement and the consequences of an inaccurate declaration by the shipper.
